Adult Liability Waiver

Release of Liability, Waiver of Claims, Assumption of Risk & Indemnity Agreement

This Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in favor of Adventure Pursuit Outfitters, its owners, officers, employees, guides, agents, successors, and assigns (collectively, "APO").

1. Description of Activity

Participant wishes to participate in guided fishing trips and related outdoor recreational activities operated by APO on Lake Texoma and surrounding waters in Texas and Oklahoma (the "Activity"). Participant acknowledges that the Activity involves inherent risks including, but not limited to: exposure to natural elements and weather, operation of watercraft, use of fishing equipment and sharp implements, slippery or uneven surfaces, wildlife encounters, physical exertion, and the possibility of serious injury or death.

2. Assumption of Risk

Participant expressly acknowledges and assumes all risks associated with the Activity, whether foreseeable or unforeseeable, including risks arising from the negligence of APO or its staff. Participant confirms they are in good physical health and have no medical condition that would prevent safe participation. Participant agrees to follow all instructions given by APO guides and staff at all times.

3. Release of Liability

In consideration of being permitted to participate in the Activity, Participant, on behalf of themselves and their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue APO from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by Participant while participating in the Activity, whether caused by the negligence of APO or otherwise.

4. Indemnification

Participant agrees to indemnify, defend, and hold harmless APO from any loss, liability, damage, or cost APO may incur due to Participant's participation in the Activity or Participant's breach of this Agreement.

5. Medical Authorization

In the event of an emergency, Participant authorizes APO staff to seek and consent to emergency medical treatment on Participant's behalf. Participant agrees to be responsible for all costs associated with such treatment.

6. Photography & Media

Participant grants APO permission to photograph or video record Participant during the Activity and to use such images or footage for promotional, marketing, or educational purposes without compensation.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising hereunder shall be resolved in the courts of Texas.

8. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
